CII Declares First Wife’s Annulment Right Un-Islamic

The CII marriage annulment ruling has sparked debate in Pakistan. The Council of Islamic Ideology (CII) has ruled that a first wife cannot annul her marriage if her husband remarries without her permission. The decision came during a session chaired by Dr. Muhammad Raghib Hussain Naeemi.

CII’s Stance on Marriage Annulment

The council reviewed multiple agenda items, including the CII marriage annulment issue. Members stated that allowing a first wife to dissolve her marriage in such cases contradicts Islamic teachings. The ruling aligns with their interpretation of Islamic law.

Premarital Testing for Diseases

The council discussed the inclusion of premarital testing for thalassemia and contagious diseases in the Nikahnama (marriage contract). Members suggested making this an optional provision. However, the final decision to marry remains with both individuals.

Human Milk Bank Discussion

The session also addressed the establishment of a human milk bank. Experts from the Sindh Institute of Child and Neonatology presented their findings. The council raised 33 questions regarding the proposal. Further research will be conducted before a final verdict.

Organ Transplantation Approval

CII ruled that kidney and liver transplants are permissible if the donor’s life is not at risk. This decision aligns with previous Islamic rulings on medical ethics.

Arabic Terms Should Remain Untranslated

The council decided that religious terms like Salah (prayer), Ayah (verse), and Masjid (mosque) should not be translated into English. They emphasized the importance of preserving these words in their original Arabic form.

Action Against Electricity Theft

Members highlighted the need to raise awareness about electricity theft. Scholars and intellectuals were urged to educate people on this issue to prevent losses.

Pension Fund Rulings

The council ruled that new employees may be required to join the contributory pension system. However, existing employees cannot be forced into it. The council also stated that pension funds must not involve interest-based financial systems.

Zakat Distribution Guidelines

CII stressed that Zakat funds must be distributed without delay. If administrative delays occur, funds can be placed in Islamic bank accounts that generate profit. In case of financial losses, the government must provide compensation.

Concerns Over Transgender Bill

The council reaffirmed its stance that the Khyber Pakhtunkhwa Transgender Bill contains un-Islamic elements. They compared it to the 2018 Transgender Act, which had already been declared inconsistent with Islamic principles. The council also objected to the inclusion of the Guru-Chela (mentor-disciple) concept in the bill.

Meeting Conclusion

At the end of the session, members offered prayers for the late mother of Chief of Army Staff General Syed Asim Munir. The meeting concluded with a commitment to further discussions on these issues.
